Do I Have A Valid Workers’ Compensation Claim?

If you or a loved one was injured on the job, you likely have many questions about workers’ compensation. One of them may simply be whether you even have a valid claim. Perhaps you’ve already gone through the initial steps of filing a claim, but your claim was denied or challenged by the insurance company.

Attorney David H. Bailly has represented work injury victims and their families his entire career. Having handled well over 3,500 workers’ comp claims across Minnesota, he can help you understand and protect your rights to fair compensation.

To schedule a free case assessment with an experienced workers’ comp lawyer, contact David H. Bailly at 952-232-1053.

What Is Workers’ Compensation?

Workers’ compensation is a no-fault process that provides compensation for employees who are injured on the job or whose daily employment activities aggravate or accelerate pre-existing health problems. Under this definition, workers’ compensation could cover anything from injuries suffered in work-related accidents, like low back or spinal injuries, to day-to-day repetitive trauma injuries that develop over time.

Workers’ compensation is a no-fault process, meaning fault is not an issue. Your employer likely works with an insurance company that provides benefits. Even if you must file a civil claim to recover denied compensation, your true opposition is your employer’s insurance company.

What Does Workers’ Compensation Cover?

If the insurance company accepts your claim, you could be entitled to any of the following based on the nature and extent of your injury or condition:

  • Medical visits and hospital bills
  • Wage-loss benefits to make up for time off needed for your recovery or inability to work
  • Compensation for any permanent disability to a specific part of your body
  • Vocational rehabilitation to change careers or find a new job, if necessary

Note that unlike personal injury claims, workers’ compensation does not cover emotional trauma or pain and suffering. Mr. Bailly works one on one with clients to help them identify all forms of coverage they may be entitled to. He can help you navigate the workers’ compensation process or appeal a denied claim so you can achieve maximum recovery.
